THE LEGAL AGREEMENTS SET OUT BELOW GOVERN YOUR USE OF THIS WEBSITE AND THE CONTENTS HEREIN. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SERVICES. By downloading material of American Copy Editors Society, their respective authors (“Authors”), subsidiaries or affiliates from this Site (collectively known as “ACES”), you (“User”) agree to the following terms and conditions. If you do not agree with such terms and conditions do not download material. If the terms of an End User License Agreement (“EULA”) accompany a particular file, the EULA shall supersede the terms below. All materials are licensed, granted and approved for personal use only. ACES grants User a limited license to access and make personal noncommercial use of this website and its contents (“Site”), and not to download (other than page caching) or modify it, or any portion of it, except with express written consent of ACES. This license does not include any resale or commercial use of this Site or its contents. Any reproduction, duplication, copying, selling or reselling, visiting, or other use of this Site or any content thereof for any commercial purpose is prohibited without express written consent of ACES. This Site is available for individuals aged 13 years or older. At all times your information will be treated in accordance with ACES’ Privacy Policy. ACES reserves the right to change content options (including availability) without notice. ACES has the right, but not the obligation, to monitor any materials submitted by you or otherwise available on the Site, to investigate any reported or apparent violation of this Agreement, and to take any action that ACES in its sole discretion deems appropriate, including, without limitation, termination hereunder or under copyright laws of the United States. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of ACES’ Sites without express written consent of ACES. You may not use any meta tags or any other “hidden text” utilizing the ACES’ and Authors’ name or trademarks or those of any affiliate without the express written consent of ACES. Distributing copyrighted material, e.g. documents, music, movies, videos, text, etc., without permission from the rightful owner violates the Digital Millennium Copyright Act (“DMCA”). Those who obtain or distribute copyrighted material should be aware that if found liable for copyright infringement, the penalties can be severe, depending upon the amount and the willfulness of the infringing activity. Certain content and services available via the Site may include materials from third parties. ACES may provide links to third-party websites as a convenience to you. You agree that ACES is not responsible for examining or evaluating the content or accuracy and ACES does not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third parties. In no event will ACES be liable for making these changes. ACES may also impose limits on the use of or access to certain features or portions of the Site, in any case and without notice or liability. All copyrights in and to the Site (including the compilation of content, postings, links to other Internet resources, and descriptions of those resources) and related software are owned by ACES and/or its licensors, who reserve all their rights in law and equity. Other trademarks, service marks, graphics, and logos used in connection with the Site may be the trademarks of their respective owners. You are granted no right or license with respect to any of the aforesaid trademarks and any use of such trademarks. ACES collects non-personal information − data in a form that does not permit direct association with any specific individual. ACES may collect, use, transfer, and disclose non-personal information for any purpose. As is true of most websites, ACES gather some information automatically and store it in log files. This information includes Internet Protocol (IP) addresses, browser type and language, Internet service provider (ISP), referring and exit pages, operating system, date/time stamp, and clickstream data. ACES uses this information to understand and analyze trends, to administer the Site, to learn about User behavior on the Site, and to gather demographic information about our User base as a whole. ACES may use this information in its marketing and advertising services. ACES’ Site may use “cookies” and other technologies such as pixel tags and web beacons. These technologies help us better understand User behavior, tell us which parts of our website people have visited, and facilitate and measure the effectiveness of advertisements and web searches. ACES treat information collected by cookies and other technologies as non-personal information. ACES may also disclose information about you if ACES determine that for purposes of national security, law enforcement, or other issues of public importance, disclosure is necessary or appropriate. ACES may also disclose information about you if ACES determine that disclosure is reasonably necessary to enforce our terms and conditions or protect our operations or Users. Additionally, in the event of a reorganization, merger, or dissolution ACES may transfer any and all personal information ACES collect to the relevant third party. ACES takes precautions — including administrative, technical, and physical measures — to safeguard your personal information against loss, theft, and misuse, as well as against unauthorized access, disclosure, alteration, and destruction. ACES does not knowingly collect personal information from children under 13. If ACES learn that it has collected the personal information of a child under 13, ACES will take steps to delete the information as soon as possible. Information you provide may be transferred or accessed by entities around the world as described in this Agreement. ACES abides by the “safe harbor” framework set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information collected by organizations in the European Economic Area and Switzerland. This Site and the content herein is published in the United States for use in the United States and other countries. The export and re-export of Site materials are controlled by the United States Export Administration Regulations and such materials may not be exported or re-exported to Cuba, Iran, Iraq, Libya, North Korea, Sudan, Syria, or any country to which the United States embargoes goods. In addition, ACES material may not be distributed to persons on the Table of Denial Orders, the Entity List, or the List of Specially Designated Nationals.
